A lawyer may be the best person to consult about this, but unless the test systematically penalized the specific group of individuals with ADHD, I think that it would be hard to demonstrate that companies using it as part of their screening/hiring are engaging in discrimination. Whether those companies are obtaining any useful information from the test is potentially the larger question.
